1. Agreement to Terms

By accessing or using DinePoll, you agree to these Terms of Service. If you do not agree, do not use the service.

2. Eligibility and Accounts

You must be legally able to enter into a binding agreement in your jurisdiction and provide accurate account information. You are responsible for safeguarding your account credentials and all activity under your account.

3. Service Description

DinePoll provides tools to create, share, and participate in group dining polls and related restaurant discovery features. We may modify, suspend, or discontinue features at any time.

4. Acceptable Use

• No unlawful, fraudulent, abusive, or deceptive activity.
• No attempts to interfere with service security, integrity, or availability.
• No scraping or automated access except as expressly permitted.
• No infringement of third-party rights.

5. User Content

You retain rights to content you submit (such as poll names and comments). You grant DinePoll a non-exclusive, worldwide, royalty-free license to host, process, and display that content solely to operate and improve the service.

6. Third-Party Services

DinePoll integrates third-party services, including restaurant data providers such as Yelp Fusion API. Your use of third-party content may also be subject to those providers' terms and privacy policies. DinePoll is not responsible for third-party content or availability.

7. Paid Features and Subscriptions

If paid subscriptions or in-app purchases are offered, pricing, billing periods, trial terms, renewal, cancellation, and refund rules will be disclosed in the app and storefront terms (such as Apple App Store policies). Where Apple billing applies, Apple's terms govern payment processing.

8. Termination

We may suspend or terminate access if you violate these Terms, create risk for users or the service, or where required by law. You may stop using the service at any time.

9. Disclaimers

DinePoll is provided on an "as is" and "as available" basis without warranties of any kind, to the maximum extent permitted by law.

10. Limitation of Liability

To the maximum extent permitted by law, DinePoll and its affiliates are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, use, or goodwill arising from your use of the service.

11. Indemnification

You agree to indemnify and hold harmless DinePoll from claims arising out of your misuse of the service, your content, or your violation of these Terms or applicable law.

12. Governing Law

These Terms are governed by the laws of the United States and applicable state law, excluding conflict of law principles, unless otherwise required by local law.

13. Changes to Terms

We may update these Terms. Material updates will be communicated through the app, website, or other reasonable methods. Continued use after updates means you accept the revised Terms.
